1. PERMITS, LICENCES & AGREEMENTS
1.1 Development Variance Permit No. DVP-344 for 1191-3rd Avenue. The permit which was issued following the Hearing to legalize the siting of the existing 12.61 metres x 7.61 metres one-storey single family dwelling with walk-out basement and to vary the minimum side yard and rear yard setbacks for basement and first storey additions and for the construction of a second storey. Also requested are second storey eave projections into the required minimum side yard and rear yard setbacks and a first storey sundeck projection into the required minimum side yard setback. 1.2 Partnering Agreement with the Fernie Chamber of Commerce for the Victoria Avenue Summer Socials (VASS) Council authorized notice of its intention to provide assistance to the Fernie Chamber of Commerce (the “Chamber”) under the terms of a Partnering Agreement for the provision of municipal services, being hosting of the “Victoria Avenue Summer Socials” (VASS) from July 2, 2014 August, 31, 2014. Funding will come through the provincial Resort Municipality Initiative (RMI) in the sum of $15,000 for services described in the Agreement, subject to the Chamber providing documentation to the City that the net proceeds from liquor sales in 2012 and 2013 were donated to a charitable organization. Staff will follow up with the Chamber to see if they are interested in amending the terms of the agreement to multiple years and bring back revisions to Council for consideration. 1.3 Royal Hotel – Temporary Change to Liquor-Primary Licence after further consultation with the public, Council determined that a 4:00AM closing time for the Royal Hotel for Saturday, April 19, 2014 to host an end of the ski season party would not be appropriate. Council denied approval to the request to extend the hours of operation for the Royal Hotel’s Liquor licence #027944 for April 19, 2014. Staff Report
1.4 Section 219 Covenant Terms of Instrument for Matrix Planning (o/b 0781609 B.C. Ltd., Inc. No. BC0781609) in accordance with the requirement for Bylaw No. 2229 cited as Zoning Bylaw No. 1750, Amendment Bylaw No. 154, 2013 was approved by Council.
2. BYLAWS
2.1 Bylaws No. 2238 and 2239 for Whitetail Drive (Focus Corporation / Parastone Developments). Council adopted both Bylaw No. 2238 and Bylaw No. 2239. The bylaws change the land use from CD1 Sub Area Zone MU2 – Multiple Unit Two and CD1 Sub-Area Zone RA1 – Resort Accommodation One to CD1 Sub Area Zone DR1 – Detached Residential One; and the zoning from Comprehensive Development One Zone, Sub-Area MU2 – Multiple Unit Two and Comprehensive Development One Zone, Sub-Area RA1 – Resort Accommodation One to Comprehensive Development One Zone, Sub-Area DR1 – Detached Residential One.
2.2 Bylaw No. 2240 for 721 – 9th Avenue (Gabrielle Ann Hogan). Council adopted zoning bylaw No. 1750, Amendment Bylaw No. 160, 2014. The zoning has been changed from R1 – Single Family Residential to R1SL – Single Family Residential Small Lot.
2.3 Bylaw No. 2236 and 2237 for 200 Burma Road (Mulyk Consulting Inc. o/b Igor and Anna Landa) Council approved and granted first and Second reading and referral to a public hearing to both Bylaws which propose to amend Official Community Plan Bylaw No. 1923 by re-designating portions of Block B, District Lot 4137, Kootenay District, Plan 1623 Except Parts Included in Plans 13159, 13562, 13933 and NEP60610 from Natural Open Space to Residential and from Residential to Natural Open Space, respectively, on Schedule ‘B’: Future Land Use Map and:
Amend Zoning Bylaw No. 1750 by rezoning portions of Block B, District Lot 4137, Kootenay District, Plan 1623 Except Parts Included in Plans 13159, 13562, 13933 and NEP60610 from RR – Rural Residential to R1B – Single Detached Plus Residential, from RR – Rural Residential to P2 – Parks and Open Spaces and from RR – Rural Residential to PP – Private Parks, respectively.
Public hearing is scheduled for Monday, April 14, 2014 at 7:00PM.

3. OTHER INFORMATIONAL ITEMS

3.1 Fernie Minor Baseball request for partial remediation of the youth diamond at James White Park.
Council authorized staff to proceed with the partial remediation for the 2014 Minor Baseball Season.
3.2 Columbia Basin Institute of Regional History
Council approved the purchase of a Corporate Membership in the Columbia Basin Institute of Regional History. The Institute is continuing its work to make the history of Fernie and the Columbia Basin public.
3.3 Elk Valley P.A.R.T.Y Program
Council authorized City support for the 2014 Program. Sessions run April 2, 9, 16 & 23, 2014 at the Fernie Hospital from 8:40am – 2:15PM. Public is welcome to attend any session to see firsthand the importance of this valuable program and the commitment of the volunteers to educating the youth throughout the area about taking risks and making smart choices.
