1. DEVELOPMENT VARIANCE PERMITS & LIQUOR LICENCES 1.1. Development Variance Permit No. DVP-332 varied Lot 3, Block 19, District Lot 4588, Kootenay District, Plan 734 (641 – 3rd Avenue) legalizing the siting of the existing dwelling, detached garage, varied the eave projections into the front and side yard setbacks, and reduced the minimum frontage and usable site area, subject to adoption of Bylaw No. 2217. Permit was issued following the Hearing, where no public submissions were received.
1.2. Development Variance Permit No. 330 varied Lot 2, Block 117, District Lot 4588, Kootenay District, Plan 902 (1421 – 8th Avenue) legalized the siting of the existing dwelling and eave projections, varied the front, side and rear yard setbacks, subject to adoption of Bylaw No. 2214. Permit was issued following the Hearing, where no public submissions were received.
1.3. Development Variance Permit No. 331 varied Lot 5, Block 81, District Lot 4588, Kootenay District, Plan 734A legalizing the siting of the existing dwelling and varied the front and side yard setbacks for the proposed addition. Permit was issued following the Hearing, where no public submissions were received.
1.4. Development Variance Permit Application No. DVPA-329 for Parcel A (See 24221A), Lot 1, Block 51, District Lot 4588, Kootenay District, Plan 734 (501 – 6th Avenue). Council authorized staff to give notice of their intention to consider issuance of the permit which proposes to vary the number of bedrooms for a secondary suite and the maximum suite size. Council will consider issuance of the permit following an Informal Hearing on August 12, 2013 where Council will receive resident feedback.
1.5. Development Variance Permit Application No. 335 for Lot 12, Block 22, District Lot 4588, Kootenay District, Plan 734 (762 – 3rd Avenue). Council authorized staff to give notice of their intention to consider issuance of the permit which proposes to legalize the eave projections of the existing structure. Council will consider issuance of the permit following an Informal Hearing on August 12, 2013 where Council will receive resident feedback.
1.6. Fernie Hotel Temporary Change Applications to Liquor Licence to extend their liquor licence to include the parking lot. Council supported their applications to the Liquor Control and Licensing Branch for proposed events, Hot August Night on Saturday, August 29, 2013 and the Joe Varosi Ball Tournament for Cancer on Saturday, September 7, 2013.
2. BYLAWS 2.1. Bylaw No. 2217, Zoning Bylaw No. 1750, Amendment Bylaw No. 149, 2013 proposes to change the zoning of Lot 3, Block 19, District Lot 4588, Kootenay District, Plan 734 (641 – 3rd Avenue) from R1 – Single Family Residential to R3 – Medium Density Residential. Following the Public Hearing that was convened to receive comments from residents (no public submissions were received), Council gave the bylaw third reading and forwarded it to the Ministry of Transportation and Infrastructure for approval.
2.2. Bylaw No. 2214, Zoning Bylaw No. 1750, Amendment Bylaw No. 146, 2013 proposes to change the zoning of Lot 2, Block 117, District Lot 4588, Kootenay District, Plan 902 (1421 – 8th Avenue) from R4 – Multiple Family Residential (High Density) to R1B – Single Detached Plus Residential. Following the Public Hearing that was convened to receive comments from residents (no public submissions were received), Council gave the bylaw third reading and forwarded it to the Ministry of Transportation and Infrastructure for approval.
2.3. Emergency Measures Bylaw No. 2222, 2013 was adopted by Council. The bylaw repealed Emergency Measures Bylaw No. 1959, 2004 and Emergency Measures Bylaw No. 1703, 2000.
2.4. Dog Licencing, Regulating and Impounding Bylaw No. 1995, 2005, Amendment No. 1, 2013, Bylaw No. 2223 was adopted by Council. The bylaw removed the increased licence fee for specific breeds of dogs.
2.5. Bylaw No. 2218 Official Community Plan Bylaw No. 1923, Amendment Bylaw No. 26, 2013 received first and second readings and was referred to a Public Hearing on August 12, 2013. The bylaw proposes to change the land use designation of Lot 12, Block 22, District Lot 4588, Kootenay District, Plan 734 (762 – 3rd Avenue) from Historic Downtown Core to Residential Infill and Intensification.
2.6. Bylaw No. 2219 Zoning Bylaw No. 1750, Amendment Bylaw No. 150, 2013 received first and second readings and was referred to a Public Hearing on August 12, 2013. The bylaw proposes to change the zoning of Lot 12, Block 22, District Lot 4588, Kootenay District, Plan 734 (762 – 3rd Avenue) from C1 – Retail Commercial to R1 – Single Family Residential.
3. OTHER INFORMATIONAL ITEMS 3.1. 2013 Paving Projects – Contract was awarded to Interoute Construction Ltd. – BA Blacktop (Cranbrook) for $1,054,559.92 exclusive of GST.
3.2. Partnering Agreement for the TransRockies Challenge 2013 was authorized by Council.
3.3. Greenhouse Gas Emission Reduction Committee. Council appointed Brendan McLean as the representative from the Fernie Chamber of Commerce to the committee and amended their terms of reference by reducing the number of community at large members from 3 to 2 and reducing the number of Council representatives from 2 to 1 with an alternate.
3.4. Max Turyk Soccer Field. Council authorized an increase to the 2013 budget of $156,282 to accommodate the purchase and installation of site enhancements and a 3,737m2 expansion of the playing area. An amendment to the 2013-2017 Five Year Financial Plan Bylaw will be required.
3.5. Handi-Dart Bus service. Council supported the Regional District of East Kootenay’s initiative which proposes to provide weekly transit within the Fernie community.
3.6. Fernie Ghostriders Junior Hockey Club requested upgrades to the Memorial Arena and Council support for their hosting a Mixed Martial Arts Competition. Council referred the upgrades to staff to review and directed staff to explore the legalities and logistics of hosting such an event in the Memorial Arena.
3.7. Fernie Trails and Ski Touring Club. Council provided an in-kind donation of 20 tables and 200 chairs to use during the Porky Blue Ride on Saturday, August 3, 2013.
3.8. Carbon Neutral Kootenays. Council resolved to subsidize $50.00 for the first 50 homes for their initial home energy assessment and 100% of the follow up assessment cost for those homes and directed staff to investigate a composting pilot project.
3.9. Elk River flood mitigation. Council met with representatives from the Regional District of East Kootenay, the Districts of Sparwood and Elkford, Teck Coal, Tembec and Canfor during the Committee of the Whole meeting. It was later resolved the Chief Administrative Officers would draft a memorandum of understanding to address mutual concerns related to flood mitigation for the Elk River and invite stakeholders to participate in meetings.
