1 DEVELOPMENT VARIANCE PERMITS & OTHER PERMITS
1.1 Development Variance Permit No. DVP-341 legalized the existing single detached dwelling located at 221 2nd Avenue by varying the maximum parcel coverage of the house (the living area only) from 25% to 28.13% and all other structures from 35% metres to 42.56%. Permit was issued following the Hearing; here no public submissions were received.
1.2 Strata Conversion Application from Zaskar Developments. Council approved the Application to Deposit Plan for strata plan EPS1664 to convert the previously occupied building situated 392-4th Avenue into four strata titled lots and authorized the Approving Officer to execute the Form T – Strata Property Act – SPA Reg. 14.5(4).
2 BYLAWS
2.1 Regional District of East Kootenay (RDEK) Bylaw No. 2451 – Elk Valley Zoning Bylaw No. 829, 1990, Amendment Bylaw No. 65, 2013. Council reconsidered their decision of September 9, 2013 and amended the resolution by striking out the reasons why Council approval was not recommended to simply state that their approval is not recommended. Several members of the community came out and spoke against the amendment.
3 OTHER INFORMATIONAL ITEMS
3.1 City of Fernie Style Guide. Council adopted the Style Guide prepared by Claris Media. This document proposes a new style that has strong and unique design elements. The colour palette and the visual elements (Fernie wordmark, Ghostrider icon and bars) were taken from the Fernie Comprehensive Signage Strategy and the updated City of Fernie website for the base of its development.
3.2 Royal Hotel’s Application for a Temporary Change to Liquor Primary Licence (for Halloween Event). Council denied the request from the Royal Hotel for an extension of their hours for a 4:00AM closing time on October 31, 2013 for a Halloween Party. Council felt the extension was not appropriate for this particular event as it was being held on a week night and at a time where the RCMP anticipate a high call load.
3.3 Property Tax Penalty – Late Payment Penalties. Council directed staff to forward the request to the Ministry for Roll No. 209 04947.081 indicating that Council is in favour of reversing the penalty of $276.76.
3.4 East Kootenay Behavior Intervention Program – Lease Agreement Council authorized the Mayor and Clerk to execute the agreement with the East Kootenay Behavior Intervention Program for a portion of Max Turyk Community Centre for one year with a two year option to renew at a monthly fee of $416.66.
3.5 Columbia Basin Alliance for Literacy – Lease Agreement. Council authorized notice of its intention to dispose of City Property via a Lease Agreement with the Columbia Basin Alliance for Literacy for two years with a two year option to renew for an annual lease amount of $5,288.30. Council will consider approval at the October 15, 2013 regular meeting.
