BYLAWS
1.1 2013-2017 Five Year Financial Plan Amendment Bylaw No. 2221, 2013 was adopted by Council. The bylaw amends the Five Year Financial Plan by increasing funding sources for grants and transfers by $100,000.00 and increasing the expenditures budget for capital works by $100,000.00 in 2013 in support of the Max Turyk Soccer Field Development Capital Project.
1.2 Bylaw No. 2217 cited as Zoning Bylaw No. 1750, Amendment Bylaw No. 149, 2013 for Lot 3, Block 19, District Lot 4588, Kootenay District, Plan 734 (641 3rd Avenue). Council approved the application, gave the bylaw first and second readings, and scheduled a Public Hearing for July 22, 2013 at 7:00 pm in Council Chambers. The bylaw proposes to rezone the property form R1 – Single Family Residential to R3 – Medium Density Residential.
1.3 Dog Licencing, Regulating and Impounding Bylaw 1995, Amendment No. 1, 2013, Bylaw No. 2223. Council gave first, second and third readings to the bylaw which shall be brought forward to the July 22, 2013 Regular Meeting for consideration of adoption. The bylaw proposes to remove the increased licence fee for specific breeds of dogs.
1.4 Emergency Measures Bylaw No. 2222, 2013. Council gave first, second and third readings to the bylaw which shall be brought forward to the July 22, 2013 Regular Meeting for consideration of adoption. The bylaw of adopted will repeal Emergency Measures Bylaw No. 1959, 2004 and Emergency Measures Bylaw No. 1703, 2000. (see item 3.2 for information related to the Emergency Planning Committee)
DEVELOPMENT VARIANCE PERMITS & OTHER PERMITS OR LICENCES
2.1 Development Variance Permit No. DVP-334 for Leffler Law Office for (Alpine Trail Place) Strata Lots 1 to 9, District Lot 4138, Kootenay District, Plan NES2856. No submissions received from the public during the Informal Hearing held prior to Council’s issuance of Development Variance Permit No. DVP-334. The development variance permit increased the cul-de-sac highway maximum length from 150 metres to 165 metres.
2.2 Development Permit Application No. DPA-431 for 421 2nd Avenue (formerly Quail Building Supplies) Lots 3 and 4, Block 10, District Lot 4588, Kootenay District, Plan 734. Council authorized issuance of Development Permit Application No. 431 which permits the landowner to undertake exterior alterations to the former Quail Building Supplies Building.
1. 2.1 Development Variance Permit Application No. DVPA-331 for 991-8th Avenue Lot 5, Block 81, District Lot 4588, Kootenay District, Plan 734A. Council approved Development Variance Permit Application No. DVPA-331 and directed staff to give notice of their intention to consider the issuance of the Permit at their July 22, 2013 Regular Council Meeting. If approved, the permit will legalize the siting and eave projections of the existing one-storey residential dwelling, vary the minimum side yard setbacks to construct an “L-shaped” south addition, and vary the projections into the front yard setbacks to construct an open porch with steps facing 8th Avenue.
2. 2.2 Development Variance Permit Application No. DVPA-332 for 641 – 3rd Avenue – Lot 3, Block 19, District Lot 4588, Kootenay District, Plan 734. Council approved Development Variance Permit Application No. DVP-332 and directed staff to give notice of their intention to issue the Permit at the July 22, 2013 Regular Council Meeting. If approved, the permit will legalize the siting and eave projections of the existing residential dwelling, vary the minimum usable site area for each unit, and vary the minimum frontage to facilitate the rezoning proposed by Bylaw No. 2217 (see item 1.2 above for more information)
3. 2.3 Royal Comete Hotel & Bar (501 1st Avenue) Structural Change Application to the Liquor Control Licencing Board (LCLB). Council supported the Royal Hotel’s application to the LCLB to amend their liquor licence to include liquor service to their outdoor patio.
4. 2.4 Fernie Hotel Temporary Changes to Liquor Licence. Council has no objection to the temporary changes to the to extend the licensed area to include the parking lot adjacent to 691 1st Avenue for the purpose of providing outdoor seating for an outdoor band on July 20, 2013 for Western Day between 11:00 – 10:00pm; and again on August 3, 2013 for the Porky Blue Bike Race between 11:00 – 10:00 pm.
5. 2.5 Special Occasion Liquor Licence for Wapiti Music Festival Beverage Gardens. Council supported the Wapiti Music Festival Society’s application to the Liquor Control and Licensing Branch for a Special Occasion Licence to operate a beverage garden during the Wapiti Music Festival at Annex Park on Friday, August 9,2013 and Saturday, August 10, 2013.
OTHER INFORMATIONAL ITEMS
6. 3.1 Cemetery Committee Terms of Reference. Council adopted the Cemetery Committee’s Terms of Reference and directed staff to advertise for volunteers and contact the Fernie Heritage Cemetery Society and the Fernie & District Historical Society for nominations from their organizations for Council’s consideration.
7. 3.2 Emergency Planning Committee Terms of Reference Council approved the Emergency Planning Committee Draft Terms of Reference and directed staff to advertise for a volunteer from the community at large and contact the organizations and agencies listed in the terms of reference for them to nominate a representative from their organization to participate on the committee. (See item 1.4 for more information on the proposed Emergency Measures Bylaw No. 2222, 2013).
8. 3.3 The Wam Bam Dirt Jump Jam – FMB World Tour 3Bronze Event Council authorized a donation of $3,000 in support of the event and offered the City’s assistance to help coordinate. Funds are to be provided through the Resort Municipality initiative. The event is to be held on July 20, 2013 from 5:25 pm until after dark at Bike Park located downtown behind the Fernie Aquatic Centre.
9. 3.4 Forum for the East Kootenays re Mental Health and Wellbeing. Council appointed Councillor Joni Krats as Council their representative to the forum for the East Kootenay in the fall which shall be focusing on Mental Health and Wellbeing from a school and community perspective. The event is being facilitated by the Healthy Communities Initiative.
