1. BYLAWS
1.1 Zoning Bylaw No. 1750, Amendment Bylaw No. 172, Bylaw No. 2264, 2014 following the public hearing Council granted third reading and referral to the Ministry of Transportation and Infrastructure for approval of the bylaw application for Stacey Goldade & Noel VanOostenbrugge (Sparrow for Hair) in the C-Hwy Zone to add a permitted use to the list of permitted uses in the C-Hwy Highway Commercial Zone.
2. OTHER INFORMATIONAL ITEMS
2.1 Proposed Boundary Extension north of Brenners Road and consideration of a Tax Rate Limitation in relation to the proposed boundary extension area Council gave direction to staff to initiate a process to extend the municipal boundary to include the property that forms a portion of the area designated UE – Urban Expansion by Schedule D of the Elk Valley Official Community Plan situated north of Brenners Road on which the Fernie Ford Dealership is being developed and which is legally described as Lot 10, District Lot 4139, Kootenay District, Plan 802.
Further to this Council gave direction to initiate a boundary extension process to increase the supply of service commercial and light industrial land in the City of Fernie by extending the municipal boundary to include the remainder of, or a portion of the remainder of, the area designated UE – Urban Expansion by Schedule D of the Elk Valley Official Community Plan and situated north of Brenners Road subsequent to the owners completing two lot subdivisions of their respective properties (as necessary);
AND THAT Council commit to including in the related boundary extension proposal to the Provincial Government a request that the supplementary letters patent associated with the boundary extension include a tax rate limitation whereby property taxes in the subject area would continue to be levied at a rate equivalent to the Regional District of East Kootenay rate until the earliest of:
a) The 2026 taxation year;
b) The taxation year following the connection of the property to municipal water service or municipal sewer service;
c) The taxation year following the adoption of a bylaw to amend the zoning of that property;
d) The taxation year following the registration in the Land Title Office of a subdivision plan or bare land strata plan for the property; or
e) The taxation year in which the property value tax rate of the Regional District of East Kootenay is equal to or greater than the property value tax rate of the municipality. |
2.2 Coal Alliance Council gave direction to staff to extend an invitation to a representative of the Coal Alliance to attend an upcoming meeting to provide Council with information about their organization as well to share information about the industry and its contributions.
2.2 BC Assessment – East Kootenay Assessment Office Council extended an invitation to the East Kootenay Assessment Office for a representative to attend an upcoming meeting to provide a presentation on their work and relationship with local governments.
2.3 Teck – Tailings Management at Tecks’ Elk Valley Operations
Council extended an invitation to a representative of the Teck Corporation to attend an upcoming meeting to provide a briefing of their operation, maintenance and monitoring of their tailings facilities; emergency response planning and Dam Safety Inspection reviews for their Elk Valley Operations.
2.4 Telus Council extended an invitation to Mr. Steve Jenkins, Regional General Manager with Telus to attend an upcoming meeting to discuss the company’s strong presence in Fernie.
2.5 Cemetery Committee Council received the January 12, 2015 Report from the Cemetery Committee and resolved to extend an invitation to Mr. Gawryluk to present the designs of the proposed monument for the Monroe Cemetery for Council’s consideration within thirty days of the January 12, 2015 Regular meeting to complete this capital project.

3.1 The next scheduled meetings of Council will be:
• January 19, 2015 at 10:00am (Special Budget Meeting)
• January 26, 2015 at 10:00am (Committee of the Whole)
• January 26, 2015 at 7:00pm (Regular )

3.2 2015/2016 Funding Applications for CBT Community Initiatives
The RDEK is accepting proposal applications for program funding until February 16, 2015 (4:30pm) for the Columbia Basin Trust (CBT) Community Initiatives and Affected Areas Programs.
Application forms are available from the RDEK at 1-888-478-7335 or the RDEK website. Eligible applicants include registered organizations that are not-for-profit, First Nations, registered schools, and local government. All proposals must be sponsored by a qualified organization and demonstrate community benefits.
