1. AGREEMENTS, LICENCES PERMITS & POLICIES
1.1 Development Variance Permit Application No. 383 – 18 Cedar Bowl Drive Council approved Development Variance Permit Application No. DVPA-383 and gave notice of their intention to consider the issuance of Development Variance Permit Application No. DVP-383 to vary the screening and fencing maximum height from ground level in a required side yard, to accommodate a 12.19 metres long x 3.0 metres high fence along a portion of the south property line.
1.2 Fernie Chamber of Commerce – Sublet Council agreed in principle to authorizing the Fernie Chamber of Commerce to sublet a portion of the municipal property which they occupy to Tourism Fernie Subsequent to the completion of planned renovations to that facility, conditional upon council agreeing to the terms of the sublet.
2. BYLAWS
2.1 Business Licencing and Regulation Bylaw No. 2028, Amendment No. 3 Bylaw No. 2290, 2016 Council adopted Business Licencing and Regulation Bylaw No. 2028, Amendment No. 3, Bylaw No. 2290, 2016. This will revise the Term of Licence to a calendar year January through December and align with the licence terms established by Elkford and Sparwood so that Fernie may participate in an Elk Valley Inter-Municipal Business Licence scheme for mobile businesses.
2.2 Zoning Bylaw No. 1750, Amendment No. 175, Bylaw No. 2278, 2014 – 4 Cedar Bowl Drive was adopted. This will rezone a 0.1073 hectare portion of 4 Cedar Bowl Drive from P2 – Parks and Open Space to R1B – Single Family Detached Plus Residential.
2.3 Bylaw No. 2292, Zoning Bylaw No. 1750, Amendment Bylaw No. 179, 2016 for the property located at 722A & 722B – 3rd Avenue. Council approved the application to amend Zoning Bylaw No. 1750 by rezoning the property from C1 – Retail Commercial to R2 – Duplex Residential; and gave it first and second reading and referred the application to a public hearing.

3. OTHER INFORMATIONAL ITEMS
3.1 2016 Roads Capital Program – Tender Award Council directed staff to increase the draft budget for the 2016 Roads Capital Program as previously presented by $43,389.00 with the increase being funded from the Streets Reserve and further, approved the award of the 2016 Roads Capital Program to BA Blacktop for the tendered price of $1,074,833.25 exclusive of GST as recommended by the City’s consulting engineers, ISL Engineering and Land Services.
3.2 2016 Water and Sewer Capital Works Program – Tender Award Council approved the award of the 2016 Water and Sewer Capital Works Program to Transcendent Mining and Mobilization Inc. for the tendered price of $436,760.29 exclusive of GST as recommended by the City’s consulting engineers, ISL Engineering and Land Services.
3.3 West Fernie Servicing & Restructure – Service Connection Timing Council authorized the connection of properties located in Phase 1 of the West Fernie Servicing & Restructure Project to water and sewer services following issuance of substantial completion of the Phase 1 construction contract conditional on the City of Fernie and the RDEK entering into a servicing agreement that would allow the City to collect user fees from those properties for the provision of sanitary sewer services.
Council also approved asking the RDEK to consent to the provision of City of Fernie sanitary sewer services to properties located in Phase 1 of the West Fernie Servicing & Restructure Project following issuance of substantial completion of the Phase 1 construction contract and prior to the completion of the boundary extension process that would bring those properties into the municipal boundary.
3.4 Fernie Brewing Company Limited – Application for Brewery Lounge Area Endorsement Staff was directed to distribute notice to affected residents and schedule an informal hearing during the regular Council meeting on Monday, April 11, 2016 at 7:00PM to receive comments from the public on The Fernie Brewing Company Limited’s application for a Brewery Lounge Area Endorsement. The applicant was present and indicated the total capacity noted in the application has been amended from 77 to 47 persons inclusive of indoors/patio.
3.5 Resolution 2015-B111: National Inquiry on Missing and Murdered Aboriginal Women Staff was given direction to bring this back to the next COTW meeting for further discussion along with information regarding the Moose Hide Campaign.
3.6 The Royal Canadian Legion Council agreed to provide Four hundred dollars ($400; ($100 dollars each)) from the Discretionary Grants Fund to members of The Royal Canadian Legion Mens Dart Team to participate in the BC/Yukon Command Darts Playdown to be held in Comox on April 1, 2016.

4.4 Bears in the Community Bears have been spotted in the community recently so we are reminding residents to store your garbage securely until collection day! We as a community need to manage our garbage and other attractants responsibly.
Residents may notice the City has added carabineers (spring loaded clamps) to secure lids on all City owned bins. Residents using the bins are asked to ensure the lids are secured following use. Remember it is unlawful to leave refuse piled on or around the bins if they are full.
As residents we can be the solution as well as being part of the problem. Let’s strive to be the solution and manage our garbage and attractants responsibly.
4.5 Funding Opportunity – Applications are now being accepted through the Resort Municipality Initiative (RMI) Festival & Event Development Program. Limited funding is available to assist community organizations with the cost of developing and hosting festivals and events.
Applicants need to be able to demonstrate financial need and that the proposed festival or event will have a positive impact on the Fernie and area tourism economy.
Deadline for completed application forms requesting funding for the 2016 fiscal year is Tuesday, May 31, 2016. Applications must be received at least two weeks prior to the date of the event. A second application intake may be offered later in 2016 if funding permits.
